The privacy of visitors to our website, like the privacy of our hotel guests, is of paramount concern to us. We believe the discreet, respectful understanding of our visitors' personal privacy is critical to a successful guest experience. We also understand that visitors to our website may have questions about what information we collect, how we collect information, how we use the information we collect online, and how we protect that information. This privacy statement answers those questions and illustrates the high degree to which we maintain and respect our visitors' privacy.

Registration is not required in order to use the website. Visitors can visit the website without informing us who they are or revealing any personal information. Visitors always have the choice not to provide any personally identifiable information.

The Townsend Hotel does not collect or store any Personally Identifiable Information (e.g. name, address, telephone number, e-mail address or associated company information) from the visitors of the Site unless submitted to us via our Contact Us web page, Visitor's Experience web page and form, the Townsend Concierge web page and form, or as otherwise provided in this Privacy Policy. If visitors choose to directly contact The Townsend Hotel through use of the Contact Us page, in order to fully respond to a request, visitors may be asked for personally identifiable information. If visitors choose not to supply the information, their ability to perform certain transactions or obtain the convenient, customized information they seek may be affected. In order to use the Townsend Concierge form, The Townsend Hotel may require visitors to provide us with their contact information (like first and last name). Such information is never sold, rented or given away to a third party or made available to the general public. If you are required to submit a photo identification (ID) via our third party mobile check-in app, the app will collect user uploaded images.

5. DATA COLLECTED BY OUR STRATEGIC PARTNERS & RESERVATIONS

Certain transactions and services offered while visiting the website may be processed or provided by strategic partners, even though it may appear that the visitor may not have left the website. For example, the strategic partner who processes hotel reservation transactions on our behalf through this website is Sabre SynXis. Please note, The Townsend Hotel does not control and will not be responsible for the privacy policies of third party websites, including websites owned or controlled by Sabre SynXis. Third party websites that are accessed through links on our websites have separate privacy and data collection practices, as well as security measures. 6. NON-PERSONAL INFORMATION COLLECTED

When you visit our website, we automatically receive certain information from your browser or mobile device, such as your browser type, the operating system of your device, the URL of the site from which you came and the URL of the site you visit when leaving the Site. We also receive your IP address and the name of your ISP or your mobile carrier. Depending on your device’s settings, we may also receive location data and other types of information sent from third party services or GPS-enabled devices. The personal information submitted to the website is stored on secure servers. The secure servers are protected by firewalls and other security procedures. Data collected by The Townsend Hotel is an asset. The Townsend recommends that visitors review this privacy policy periodically, as The Townsend Hotel reserves the right to amend, modify or revise this statement from time to time. When this privacy statement is changed, modified and/or amended, the revised privacy statement will be posted on the website. Any revised privacy statement will only apply prospectively to new information collected or modified after the effective date of the revised statement.

13. COOKIES AND INVISIBLE PIXELS

The Site may send a “cookie” to your computer. A cookie is a small piece of data sent to your browser from a web server and stored on your computer’s hard drive. A cookie cannot read data off your hard disk or read cookie files created by other sites. Cookies do not damage your system. 14. CHILDREN ONLINE PRIVACY PROTECTION ACT

The Townsend takes special care to protect the privacy needs of children under the age of 13 and The Townsend encourages parents to be an active participant in their child’s online activities. The Townsend abides by the Children’s Online Privacy Protection Act (COPPA) and other relevant laws. The website does not target and is not intended for children under the age of 13, and The Townsend will not knowingly collect personal information from them. In fact, the Site is not intended for anyone under the age of 18. If The Townsend discovers personal data from a child under the age of 13 is gathered through the Site, without parental consent, The Townsend will eliminate that data. If you are under the age of 13, you must ask a parent or legal guardian for permission prior to submitting any information to this Site.

15. CALIFORNIA PRIVACY NOTICE

Under Section 1798.83 of the California Civil Code, residents of California can obtain certain information from companies with whom they have an established business relationship. 16. THIRD PARTY DISCLOSURE AND INFORMATION SHARING

Except as set forth in this Privacy Policy or as specifically agreed to by You, The Townsend will not disclose any Personally Identifiable Information gathered from you on the Site.

A. We may share Personally Identifiable information in a limited fashion to our contractors, consultants and service providers that perform services on our behalf, including operation of the Site technology, marketing services, and other related services. Unless you have opted-out (see Section 16.C. below) of such sharing, these contractors, consultants and service providers also may have access to your email address to send newsletters or other information to you on our behalf. Access to your Personally Identifiable Information by such contractors, consultants and service providers is limited to the information reasonably necessary for the contractor, consultant or service provider to perform its limited function for The Townsend. D. Finally, The Townsend may provide content and services to you through websites other than our own. The Townsend will not disclose your Personally Identifiable Information to these third party websites without your consent. However, any information you choose to disclose on such sites is NOT subject to this Privacy Policy.

17. DO NOT TRACK NOTICE

Your browser may provide you with the option to send a “Do Not Track” signal to websites you visit. This signal is used to request that websites not send the requesting device cookies, but websites have no obligation to respond to such signal or to modify their operation. At the current time, our website is not programmed to recognize Do Not Track signals, so the Site will not treat you differently if we receive such signals from your browser and we may not comply with Do Not Track settings on your browser.
